Review Of Hackney Carriage/Private Hire Driver's Licence (Ref: HD3165)

Minutes:

A report was provided to the Committee regarding a review of Hackney Carriage/Private Hire Driver’s Licence (Ref: HD3165).


On 9 January 2018, HD3165 submitted two ‘Notification of Intended Prosecution’ forms to the Licensing Team. These forms provided details of two separate motoring offences from 29 June 2017 and 24 July 2017, which had occurred when HD3165 was working as a licensed driver. The motoring offences HD3165 had declared were detailed in paragraph 3.2 of the report and Members were informed that the offences had not been declared within the Council’s ‘7 Day Rule’.

These offences were subsequently confirmed in a DVLA check conducted on 9 January 2018 which revealed that HD3165 currently had a total of ten penalty points on their DVLA Driving Licence, six of which were currently ‘live’ for totting up purposes.

The Notification of Intended Prosecution, Conviction or Fixed Penalty Notice Received during currency of Licence, DLVA Driver Details and Operator records for 29 June 2017 and 24 July 2017 were attached to the report at Appendices A to C respectively.

                       

HD3165 failed to appear before the Committee. Members decided to consider the Review in HD3165’s absence as HD3165 had been provided with ample notice of the meeting and no reasonable excuse for non-attendance had been offered.


*           Resolved
that on the balance of probabilities, the licence of

Hackney/ Private Hire Driver (Ref: HD3165) be suspended for a period of two weeks on the grounds of ‘any other reasonable cause’, pursuant to Section 61 of the Local Government (Miscellaneous Provisions Act) 1976 and the Council’s Policy, due to the evidence detailed in the report.
