P/2009/0417 Eccleston Grange, Prescot Road The installation of an effluent treatment plant and associated works.
The Development Service Manager informed Members of a 48 signature petition that had been received in relation to the application after publication of the agenda.
A resident objecting to the application appeared before the Committee to present her case.
Grant permission, subject to the following conditions:
1. time limit under section 91 – the development must be begun within three years of the date of the decision; 2. submission of an Odour Impact Assessment – Prior to the development being brought into use, an Odour Impact Assessment shall be submitted to and agreed in writing by the Local Planning Authority. The assessment shall include a scheme for odour abatement, monitoring and mitigation measures (to prevent odour complaints). The development shall not be brought into use until the measures identified within the Odour Impact Assessment have been implemented; 3. protection of trees – The provision of total exclusion zones must be achieved by the erection of protective fencing and ground protection, to not less than the minimum standard contained in British Standard BS5837 (2005) as per the document Method Statement Arboriculture Works and Tree Protection. The area so defined shall be kept free of machinery, stored material of all kinds and any other form of ground disturbance not specifically catered for in the agreed measures, for the duration of the site and building works. The St Helens Trees and Woodlands Officer must be contacted prior to any development taking place on site to inspect and ensure that the fencing has been constructed as specified in the Method Statement Arboriculture Works and Tree Protection and is located as shown in the tree protection plan; 4. arboricultural Supervision. – Details of how Arboricultural supervision will be provided where works impact on trees within the site and these shall be agreed in writing with the Council as Local Planning Authority and implemented prior to the commencement of the development as such. The details on arboricultural supervision will include the frequency of visits to the site and be in agreement with the St Helens Trees and Woodlands Officer and also include the method by which the Arboricultural Consultants will report to the Local planning Authority on progress with the development in relation to its impact on trees within the site. All work carried out on trees should be carried out to British Standard BS 3998 (1989); 5. Replacement Trees. – All trees felled must be replaced with two new heavy standard root ball trees, secured with tree stakes and ties. The species, location and specification of these trees id to be agreed in writing with the Council as Local Planning Authority; 6.
