Disciplinary Appeal - DB - Chief Executive's Department

Minutes:

The Committee had been convened to consider a disciplinary appeal brought by DB, Chief Executive’s Department.

 

The Committee were informed that a telephone call had been received just prior to the scheduled start time of the hearing from the Appellant’s Trade Union, advising that the Appellant’s Trade Union Representative was on sick leave. Neither the Appellant nor their Trade Union Representative had attended the Committee hearing.

 

A further telephone call was made to the Trade Union to seek further details and it was confirmed that a postponement was requested on the grounds that the Trade Union Representative was on sick leave and no alternative representation could be arranged. It was also confirmed that DB had been advised by his union not to attend the Committee hearing without Trade Union representation.

Management were in attendance and were given the opportunity to respond to the postponement request.

 

Members then discussed the request, during which they expressed their dissatisfaction with the manner in which the postponement had been requested by telephone and at very short notice.

*           Resolved that:

(1)        the appeal be adjourned; and

 

(2)        that a letter be sent from the Chief Executive to all Unions reminding them of the protocol for requesting postponements of hearings of this Committee.
