Medical Incapacity Appeal - RB - Adult Social Care and Health Department

Minutes:

The Committee had been convened to consider a medical incapacity appeal brought by RB, Adult Social Care and Health Department.

 

The Principal Human Resources Officer and the Dismissing Officer appeared before the Committee.

 

Neither RB nor his representative attended the hearing. Emails received from RB were read out to the Committee and given that RB had provided no reason as to why he was unable to attend the appeal hearing, nor had he indicated that he would attend if the hearing was adjourned to an alternative date, the Committee decided to proceed to hear the case in RB’s absence.

Management presented its case and the Committee also considered the email that had been received from RB on 16 March 2015. Management then withdrew whilst the Committee considered the matter. The Committee considered all of the evidence within the bundle, the email received from Mr Beck on 16 March 2015 and the case put forward by Management at the hearing. 

 

*           Resolved that the appeal be dismissed for the reasons set out in the letter of the Assistant Director for Contracts and Business Support (Adult Social Care and Health) dated 21 October 2014.

 

 

Management were recalled to the meeting and informed of the Committee’s decision.
